Minister tells ADCU bogus self-employment is unacceptable

Kate Dearden said worker rights apply whatever the platform model; HMRC and the Fair Work Agency will act on breaches.

The App Drivers & Couriers Union has published a government reply stating that bogus self-employment is unacceptable and that worker rights apply regardless of business model.

In a 1 September 2026 letter, Minister of State for the Future of Work Kate Dearden MP, responding for the Secretary of State to ADCU’s 22 July letter, said employers must not deny rights by falsely labelling people self-employed, and that National Minimum Wage and paid leave obligations apply even where pay is algorithmic. HMRC and the Fair Work Agency “will not hesitate” where employment law is broken. The department would not comment on named companies. ADCU says Uber remains in breach of the Supreme Court worker-status judgment and wants the employment-status consultation fast-tracked.
